Dobson Marine Services Ltd will be referred to as Dobson Marine in this document.


Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using any service provided by Dobson Marine.


Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.


By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

 

Accuracy of Information

 

At Dobson Marine we try to ensure all information we provide is complete, accurate and current. Despite our best-efforts information may occasionally not be up to date and certain information may change without notice.

We reserve the right to discontinue any product at any time.


Terms of Sale


When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order. By placing an order with us you are (i) offering to purchase a product (ii) confirming that all information you have provided to us in connection with an order is correct, and (iii) that you are an authorised user of the payment method provided by you.

We reserve the right to refuse any order request made by you. Prior to our acceptance of an order, we may require verification of information.

If an item is listed at an incorrect price, through error, we reserve the right to refuse or cancel any such order placed for the incorrect price, regardless of whether the order has been processed.

If payment has already occurred, we will credit your account in the amount of the incorrect price. Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and may not include any of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown assembled, they may require some assembly by you (i.e. remote-control outboards will need controls attaching to outboard). By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.


How to place an order

 

You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time. If you prefer to order by telephone, you can do so by calling 07792758834. If purchasing from a quote, the buyer accepts full responsibility for checking the accuracy of that quote.

The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.

Carriage charges will be shown prior to you placing your order.



Payment Terms

 

You will be required to pay for the goods in full at the time of ordering. We use secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard or Delta/Connect. All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate unless otherwise stated on the ad.

 

Shipping and Delivery

 

We aim to get any items purchased through us to you as quick as possible, however, shipping and delivery durations will be subject to suppliers own shipping and delivery terms.

Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. If there is no one to accept the order on the scheduled delivery date the goods may be returned to the factory, and we reserve the right to charge you an additional re-delivery charge. Deliveries are made to a ground floor entrance only and on the condition that there is reasonable access for the safe and prompt delivery of the goods. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of God, war, riot, civil commotion, malicious damage or the default of our suppliers. On any of these points, which are out of our control, we are not responsible for delayed delivery.

We can ship our products to any location within mainland Great Britain and the Republic of Ireland, including the islands and the Highlands/Islands of Scotland. However, please note that any shipping fees indicated online apply solely to mainland England and Wales; all other regions will incur an additional shipping charge.

Delivery is typically completed within 5 to 7 working days; however, due to availability issues, it may occasionally take longer, as certain components may need to be sourced from Japan. Should you have any questions, please do not hesitate to contact us via email to verify availability.

 

Returns/cancelations/refunds

 

All customers may reserve their right to cancel their order up to 14 days after their order delivery. Reason does not need to be given, the return on cancellation is limited to 14 days after informing us of cancellation. Refund will be issued within 14 days of receiving the goods. This is subject to inspection of goods and ensuring they have not been altered or damaged.

Faulty Goods / Guarantee

If there is a problem with the goods, please notify us by email or in writing providing details of the problem. In addition, you must provide us with a digital photograph of the problem as this saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.

All goods are covered by a manufacturer’s warranty against faulty workmanship and materials, subject to the terms and conditions of that warranty.

The manufacturer’s warranty is provided in addition to that which the law affords you as a consumer and accordingly, your statutory rights are not affected.

If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until either an indicative digital image is supplied by the customer (and accepted by us as proof), or the original goods have been received at our warehouse and checked.

The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

New Outboard engines are covered by a statutory warranty of 2 years from date of purchase, any additional warranties offered are at the discretion of the manufacturer and the servicing schedule must be adhered to for these warranties to be valid. Noteworthy point is that one stipulation of manufacturers warranties requires that a registered dealer for that brand execute all servicing up to and including the end of the warranty period.

Used outboards sold by us are subject to a statutory warranty period of 3 months from date of purchase/delivery, any further warranty offered is at our own discretion and all warranties are subject to misuse, abuse, and neglect. FUEL: no warranty is given or implied for failures/faults which are attributable to fuel contamination or old fuel, this covers such faults as but not exclusive to: dirt in carburettors, dirt in fuel injectors, faulty fuel pumps due to debris etc.

Oil: Outboard engine warranties do not cover faults or damage because of too much or too little engine oil. In the case of 2 stroke engines the correct mix of oil: fuel is the responsibility of the operator and not the company. In the case of 4 stroke outboards the oil level should be checked before EVERY use by the operator. Any damage resulting from incorrect oiling of an outboard engine will not be covered under warranty.


Changes


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.


 Liability

 

The products sold on this website and by the company have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.

We do not accept liability for any consequential loss of profit, time, labour costs or indirect losses because of faulty goods.


Service work


Boats, engines and trailers that are repaired, moved or stored on the premises of Dobson Marine Services are kept at the sole risk of the customer.
All repair and installation work undertaken is done so on the understanding that the work shall be carried out either by a Dobson Marine services engineer, or an engineer nominated by Dobson Marine Services.


Liability 

 

We shall not be liable for any loss or damage caused by events or circumstances beyond our reasonable control (such as severe weather conditions, the actions of third parties not employed by us or any defect in a customer’s or third party’s property); this extends to loss or damage to vessels, gear, equipment or other property left with us for work or storage, and harm to persons entering our premises or using any of our facilities or equipment. We shall take reasonable and proportionate steps having regard to the nature and scale of our business to maintain security at our premises, and to maintain our facilities and equipment in reasonably good working order; but in the absence of any negligence or other breach of duty by us vessels and other property are left with us at the customer’s own risk and customers should ensure that their own personal and property insurance adequately covers such risks.

We shall not be under any duty to salvage or preserve a customer’s vessel or other property from the consequences of any defect in the vessel or property concerned unless we have been expressly engaged to do so by the customer on commercial terms. Similarly, we shall not be under any duty to salvage or preserve a customer’s vessel or other property from the consequences of an accident which has not been caused by our negligence or some other breach of duty on our part. However, we reserve the right to do so in any appropriate circumstances, particularly where a risk is posed to the safety of people, property or the environment. Where we do so we shall be entitled to charge the customer concerned on a normal commercial basis.

Customers may themselves be liable for any loss or damage caused by them, their crew or their vessels and while their vessel or other property is on our premises or is being worked on by us, they shall be obliged to maintain adequate insurance, including third party liability cover for not less than 2,000,000, and, where appropriate, Employers’ Liability cover in respect of any employee. Customers shall be obliged to produce evidence of such insurance to us within 7 days of a request to do so.


Vessel Movements 


4.1 We reserve the right to move any vessel, gear, equipment or other property at any time for reasons of safety, security or good management of our business and premises.


Retention of tittle

 

Title to all goods, equipment and materials supplied by us to a customer shall remain with us until full payment has been received by us.
